This website is owned and operated by Pious Projects of America (“Pious Projects,” “we,” “us,” or “our”). These Terms and Conditions of Use govern your use of www.Gazakicks.com& Gazakicks.org (the “Sites”) and all services, including fundraising campaign creation and donations, accessing resources, user registration, account management, and all related features. These Terms and Conditions of Use Agreement (these “Terms”) are a binding legal contract between you (“You” or “Your”, either an individual or a legal entity) and Pious Projects of America (“Pious Projects”).
These Terms govern your access and use of the site and any media, software, programs, services, tools, features, materials, content, features, products, or information available on or through it or used in connection with it (collectively, the “Services”).
You will be bound by these Terms by accessing or using any part of the site. If You do not agree to these Terms, Pious Projects is not willing to grant you any right to use or access the site and Services. In such event, you are not granted permission to access or otherwise use the site and are instructed to exit the site immediately.
IMPORTANT NOTICE: THESE TERMS CONTAIN AN ARBITRATION CLAUSE AFFECTING YOUR LEGAL RIGHTS. PLEASE READ THE ARBITRATION CLAUSE CAREFULLY AS IT REQUIRES YOU TO ARBITRATE DISPUTES WITH PIOUS PROJECTS ON AN INDIVIDUAL BASIS, LIMITS YOUR ABILITY TO SEEK RELIEF IN A COURT OF LAW, AND WAIVES YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.
We may modify these Terms at any time by posting revised Terms on our site, and if we do so, we will let you know either by posting the modified Terms on the site or through other communications, such as the email address you submitted to us. We advise you to review the Website periodically for updates to Terms. Use of the site following modifications to the Terms constitutes your acceptance of revised Terms. The contents of this site may include technical inaccuracies or typographical errors. We may publish changes to the contents without prior notice to you. We may also make improvements and/or changes in the services and/or the features described herein at any time without prior notice to you. We shall have the right to revise and edit these contents at any time. By linking, accessing, browsing, and/or using this site, you agree to be bound by any such revisions.
If you do not agree to be bound by the modified Terms, then you may not use the site anymore. Because our services are evolving, we may change or discontinue all or any part of the site, at any time and without notice, at our sole discretion.
Pious Projects of America is a non-profit 501(c)(3) tax-exempt charitable organization based in Illinois. The purpose of our site and services is to foster a worldwide sense of community to link between those who are capable and those in need. Our mission is to respond efficiently, effectively, and purposefully to humanitarian causes around the world while maintaining the integrity of our donations in an ethical and transparent approach.
Pious Project of America provides an online platform where users can start fundraising campaigns for humanitarian and infrastructure development projects such as building water wells and mosques. Additionally, through our search tools, all visitors to the Site can search through different projects and choose to donate to the ones that best match their philanthropic interests.
To access certain features (like starting a campaign or donating), you may need to register and maintain an active account (“User Account”), and this may require both a username and a password. You may also have to provide certain registration information, all of which must be accurate and updated as they change.
You are not allowed to share or give your users account details to anyone else. You are responsible for maintaining the confidentiality of Your password, and you agree not to use another person’s user account details or select a user account detail:
You further acknowledge and agree that you shall have no ownership or other property interest in Your account and/or username, and you also acknowledge and agree that all rights in and to your username and account are and shall forever be owned by and inure to the benefit of Pious Projects. Failure to comply with the foregoing shall constitute a breach of these Terms, which may result in immediate suspension or termination of your user account. Pious Projects will not be liable for any loss or damage arising from your failure to comply with these obligations. Pious Projects reserves the right to delete or change user accounts (with or without notice) at any time and for any reason.
You represent that you have the legal right to make donations. Donations are voluntary and cannot be refunded except in cases of special circumstances, technicality, fraud, or chargeback fees on our end. You agree to provide accurate and complete donation information. We rely on this to process your donations properly. If we are unable to verify your payment info, your donation may be canceled, or access to your account may be limited. Any declined or canceled payments will be communicated to you.
After making a donation, you will receive a confirmation email with details of your donation and payment information for your records.
Your donation to Pious Projects is tax deductible to the full extent of the law – consult your tax advisor. We reserve the right to determine at our sole discretion whether to accept, refuse, or return any donation.
Pious Projects will collect donations on our platform on behalf of any active project. Pious Projects will then deduct any fees applicable to the donation, including but not limited to all credit card fees, transfer fees, chargeback fees, overdraft fees, service charges and all fees associated with receiving the donation. Applicable fees are 3% + $0.35 for Credit Cards. While we aim to maintain consistent policies, Pious Projects reserves the right to introduce new fees or alter existing fee amounts and structures when necessary. We rely on third party payment processors and financial institutions that may themselves change service charges and transaction fees from time to time. If applicable fees change because of such third-party providers, we may need to adjust or introduce new fees accordingly to cover these changes.
The site you have accessed and all of its contents as a whole and in part are protected by copyright, trademark, service mark, trade name, and other intellectual property and are owned or controlled by Pious Projects, its affiliates, and licensors. The site is licensed to You, not sold. Except for the limited license granted in these Terms, Pious Projects and its licensors retain all rights, title, and interest in the site and all proprietary rights in the site and services, including without limitation copyrights, patents, trademarks, service marks and trade names.
Pious Projects may change, suspend, or discontinue any aspect of the site and services at any time. Pious Projects, its suppliers and service providers reserve all rights not granted in these Terms.
Grant of License: Pious Projects grants You a personal, revocable, nontransferable, nonexclusive license to use the site and the service for personal, non-commercial purposes, conditioned on your continued compliance with these Terms.
Limitations on License. The license granted to You in these Terms is restricted as follows:
A. Use any “deep link,” “page-scrape,” “robot”, “spider”, or other automatic devices, program, script, algorithm or methodology, or any similar or equivalent manual process to access, acquire, copy, or monitor any portion of the site or in any way reproduce or circumvent the navigational structure or presentation of the site to obtain or attempt to obtain any materials, documents, or information through any means not purposefully made available through the site;
B. Attempt to gain unauthorized access to any portion or feature of the site, including without limitation, the account of any other authorized user or any other systems or networks connected to the site or to any server used by Pious Projects or to any of the services offered on or through the site, by hacking, password “mining” or any other illegitimate or prohibited means;
C. Probe, scan, or test the vulnerability of the site or any network connected to the site, or breach the security or authentication measures on the site, or any network connected to the site;
D. Reverse look-up, trace, or seek to trace any information on any other authorized user of or visitor to the site;
E. Take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the site or systems or networks of Pious Projects or networks connected to the site;
F. Use any device, software, or routine to interfere with the proper working of the site or any transaction being conducted on the site, or with any other person’s use of the site;
G. Use the site to harvest or collect email addresses or other contact information;
H. Market, co-brand, private label, separately distribute, resell or otherwise permit third parties to access and use the site without the express, separate and prior written permission of Pious Projects;
I. Create an intact reproduction of a page or pages of the site into another site; or
J. Use the site in an unlawful manner or in a manner that could damage, disparage, or otherwise negatively impact Pious Projects.
Your submissions represent you fully own all rights or have secured all necessary permissions to share the content publicly. You grant us a perpetual, royalty-free license to use submissions in association with the operation of our Site and services.
Pious Projects respects the intellectual property of others and asks its users of the platform to do the same. Pious Projects Services may not be used to transmit, retransmit, distribute, post, or store any material that violates any rights of any person, including rights protected by copyright, trade secret, patent, or other intellectual property or similar laws or regulations.
Pious Projects has established procedures for enforcing this statement which is designed to be in accord with the Digital Millennium Copyright Act. If you believe that your copyrighted work has been copied and is accessible on any of the Pious Projects Services in a way that constitutes copyright infringement, please notify us by sending us an email at support@piousprojects.org.
In order to be valid, the notification must be in writing and must contain the following information and be submitted to us:
Please note that any person who knowingly misrepresents to Pious Projects that material is infringing shall be liable to Pious Projects and/or the alleged infringer for any damages (including costs and attorneys’ fees) suffered or incurred by Pious Projects and/or the alleged infringer as a result of Pious Projects’s reliance on such misrepresentation and removing or disabling access to such material. ii) Similarly, any person who knowingly misrepresents to Pious Projects that the material was removed or access blocked by mistake or misidentification shall be liable to Pious Projects and/or the copyright owner or its authorized licensee for any damages (including costs and attorneys’ fees) suffered or incurred by Pious Projects and/or the copyright owner or its authorized licensee as a result of Pious Projects relying on such misrepresentation and replacing such removed or blocked material.
Pious Projects has the right, but not the obligation, to monitor the content of the Site (including any social or tools, services or functions that enable the sharing, display, or performance of any content or material), to determine compliance with these Terms and any operating rules established by Pious Projects, and to satisfy any law, regulation or authorized government request. Pious Projects has the right and sole discretion to edit, refuse to post or remove any content submitted to or posted on or within the Site, including, without limitation, the right to remove any content or material that Pious Projects, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.
Consent to Electronic Transactions, Communication and Disclosures
To the fullest extent permitted by law, these Terms and any other agreements, notices or other communications from Pious Projects to you regarding our services being offered (“Communications”) may be provided to you electronically, and you consent and agree to receive Communications in an electronic form. Electronic Communications may be posted on the pages within the Pious Projects website and/or delivered to your email address.
Also, you expressly consent to be contacted by us, our agents, representatives, affiliates, or anyone calling on our behalf for any and all purposes at any telephone number, physical or electronic address you provide, or any other place where you may be reached. You agree we may contact you in any way, including SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using an auto telephone dialing system or an automatic texting system. Automated messages may be played when the telephone is answered, whether by you or someone else.
We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account and stop using our Site and services anytime. The following sections survive termination: Donations, Content You Provide, Liabilities Waiver, and Limitation of Liability.
Pious Projects may provide links, in its sole discretion, to other sites and services. Pious Projects is not responsible for the availability of these outside resources or their contents. Pious Projects expressly disclaims any responsibility for the content, materials, accuracy of information and/or the quality of the products or services provided by, available through, or advertised on these third-party sites, or the products or services provided by any third party.
You may link to our Site and Service provided that you do so in a way that indicates that the link is direct to the Pious Projects of America Site and is fair and not misleading. You may not integrate or make use of all or part of the Site in ways that would confuse or mislead visitors as to the nature and origin of the Site’s content.
Pious Projects works with vetted third-party charitable organizations and partners to facilitate the implementation of some infrastructure development projects funded through our website. We conduct screening and due diligence on existing and potential partner entities to ensure shared commitments to integrity, impact, and transparency over donor-supported work.
We maintain formal partnership agreements covering permitted uses of funds, reporting requirements, auditing rights, traceability standards, and other matters, upholding accountability around how donations are applied towards published project goals.
While we aim to confirm donations are applied toward stated campaign purposes, we cannot guarantee specific project outcomes or assume liability for third-party efforts we help fund. By using our site to make donations towards said projects, you acknowledge your funds may ultimately be distributed in grant form to partner charity entities with independent governance subject to the oversight provisions in our binding contract.
When accessing and/or using the Website and the Services we offer, we may obtain certain information about you, or you may be required to provide certain information to us. All uses of your information will be treated in accordance with our Privacy Policy, which herein forms an integral part of these Terms. Please refer to our Privacy Policy for information on how we collect, use, and disclose information from our users.
We aim to provide helpful Site tools and resources but cannot control or guarantee their accuracy, completeness, or reliability. YOU EXPRESSLY AGREE THAT THE USE OF THE SITE AND SERVICE IS AT YOUR SOLE RISK, AND YOU ASSUME ALL RISK. THE SITE AND ITS INFORMATION, CONTENT, MATERIALS, SERVICES, AND USER CONTENT IS PROVIDED ON AN “AS AVAILABLE” “AS IS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIOUS PROJECTS AND ITS LICENSORS DISCLAIM ALL WARRANTIES WITH RESPECT TO THE SITE AND SERVICES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, TITLE, MERCHANTABILITY, QUIET ENJOYMENT, QUALITY OF INFORMATION, FITNESS FOR A PARTICULAR PURPOSE, AND RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE. PIOUS PROJECTS DOES NOT ENDORSE, RECOMMEND, OR MAKE ANY WARRANTIES AS TO THE CONTENT, INFORMATION, MATERIALS, USER MATERIALS, FEATURES, SERVICES, OPINIONS, OR STATEMENTS AVAILABLE ON OR THROUGH THE SITE OR THROUGH LINKS ON THE SITE. PIOUS PROJECTS DOES NOT WARRANT THAT THE SITE AND SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SITE WILL BE CORRECTED. YOU SPECIFICALLY ACKNOWLEDGE THAT PIOUS PROJECTS IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PIOUS PROJECTS OR ITS SUPPLIERS/LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE), WHICH INCLUDE, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, LOST PROFITS, LOST DATA AND BUSINESS INTERRUPTION, ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SITE, ITS CONTENT OR SERVICES, OR ANY OF ITS THIRD PARTY CONTENT OR SERVICES AVAILABLE ON OR THROUGH THE SITE, EVEN IF PIOUS PROJECTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, THE ENTIRE LIABILITY OF PIOUS PROJECTS AND ITS SUPPLIERS/LICENSORS UNDER THESE TERMS FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) IS LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESS TO THE SITE.
Some states do not allow the exclusion of incidental or consequential damages or the limitation on how long an implied warranty lasts, so some of the above may not apply to You.
You agree to defend and indemnify Pious Projects from any claims, damages, losses or expenses related to: (a) your use or misuse of the site; (b) any user content or information you provide or make accessible through the site; or (c) your violation of any policies, terms or applicable laws. We reserve the right to handle claims however we see fit. This indemnity applies to any affiliates, contractors, officers or directors arising from the matters indemnified.
These Terms shall be governed by and interpreted in accordance with the laws of the State of Illinois without reference to conflict of law principles.
Any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its comprehensive arbitration rules and procedures by a sole arbitrator. Judgment on the arbitration award may be entered in any court having competent jurisdiction. Unless otherwise expressly required by applicable law, each party shall bear their own costs, legal and expert fees incurred in the arbitration irrespective of outcome.
Notwithstanding the above, we reserve the right to pursue injunction proceedings before any court of competent jurisdiction for the protection or enforcement of Our intellectual property rights arising from these Terms.
You and Pious Projects agree, to the fullest extent permitted by applicable law, that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, if the parties’ dispute is resolved through arbitration, the arbitrator may not consolidate another person’s claims with your claims and may not otherwise preside over any form of a representative or class proceeding.
Assignment: Users may not transfer or assign any rights under these Terms. We reserve the right to transfer or assign our rights and obligations under these Terms in connection with a merger, acquisition or sale of assets, by operation of law or otherwise.
Severability: If any provision of these Terms is found unenforceable, only that provision will be removed and the remaining terms will stay effective.
Waiver: No waiver of any of the provisions of this Agreement will constitute a continuing waiver unless otherwise expressly so provided in writing. The failure of either Party to enforce any of the provisions of this Agreement at any time, will in no way be construed to be a present or future waiver of such provisions. We do not guarantee that well will pursue legal actions against all breaches of this Agreement.
Force Majeure: Notwithstanding the other provisions of this Agreement, if Pious Projects is in good faith prevented from performing its obligations under this Agreement because of an event beyond its control, including without limitation, any act or omission of our third-party partners, pandemic, earthquake, flood, and other natural calamities, Pious Projects will be relieved from performing its obligations provided that, it will take all reasonable steps to promptly remedy the cause of such delay or failure if it is in its power to do so.
